Proporcionalidad de la infracción por la falta de pago del sistema tranviario de Cuenca

Abstract
The objective of this investigation is to establish the importance of the application of the principle of proportionality in the sanctioning resolutions of administrative law, specifically the subject to be analyzed is the imposition and collection of the fines generated due to the non-compliance with the payment of the use of the tramway in the city of Cuenca, during the first semester of the year 2021; fact that is of great importance to ensure compliance with the Constitution and the fundamental rights of citizens who use this means of mass transportation.
Constitutional principles are mandatory, the same ones that coexist with other rights and principles of the same nature with which they may conflict, so judges must weigh the principles so that one prevails over the other, to know which principle will prevail, the costs and benefits that such a decision would entail must be analyzed. It has been established that the principle of proportionality must be applied in a mandatory manner in all administrative sanctions in order not to violate the fundamental rights of those sanctioned, which must comply with certain parameters for its application, which is why its study it becomes necessary.
In relation to the methodology, the deductive method focused on delimiting the object of knowledge will be applied starting from the general to the particular in the established area of study. In the same way, the research is exploratory for which the qualitative and quantitative method will be applied. As research techniques to verify the degree of satisfaction of the mentioned policies and the quality of the public service, structured surveys will be used to a considerable sample of the population of the territory.
At the end of the investigation, it will be concluded that the principle of proportionality must be applied for the imposition of fines for non-payment of tram users in the city of Cuenca, in order to guarantee due process.
